Terms and Conditions of BookOnZaatio

BookOnZaatio (a Zaatio company) operates an event ticketing platform exclusively in India for live events (concerts, seminars, shows, classes, etc.). By using our platform and purchasing tickets, you agree to these Terms and Conditions. If you do not agree, you must not use BookOnZaatio. These Terms govern user and event organizer conduct, ticket sales, and related services on BookOnZaatio.

1. Eligibility and User Accounts

Legal Capacity: You must be at least 18 years old and have full legal capacity under Indian law to use BookOnZaatio. Users under 18 may use the service only with parental or guardian supervision.

Registration: To make purchases, you may be required to register an account. When registering, you must provide accurate, complete and current information. You agree to update your registration data promptly if it changes. If any information you provide is untrue or incomplete, we may suspend or terminate your account. You are responsible for all activity under your account. Keep your login details confidential; we are not liable for losses due to unauthorized use of your account.

User Conduct: You agree to comply with all applicable Indian laws (including consumer protection and event regulations). You must not use the site for any unlawful purpose. You also agree not to transfer or authorize others to use your account.

2. Event Organizer Terms

Accuracy of Event Information: Event organizers listing events on BookOnZaatio must ensure all event details (date, time, venue, pricing, content, etc.) are accurate and lawful. Organizers are responsible for obtaining all necessary permissions, permits, and licenses for their events. BookOnZaatio is not responsible for the accuracy or legality of any event.

Ticket Pricing: Event organizers set all ticket prices. Ticket pricing will be fixed by the Event Organizers and BookOnZaatio will not be responsible for the ticket pricing. BookOnZaatio merely facilitates sales on behalf of organizers. We do not control or guarantee prices or inventory; pricing errors may result in cancellation and refund of affected tickets.

Cancellations/Postponements: If an event is cancelled or postponed by the organizer, BookOnZaatio will attempt to notify you and process refunds or credit as per the organizer's policy. BookOnZaatio itself is not liable for canceled or changed events. Organizers, not BookOnZaatio, are responsible for providing refunds or rescheduling tickets in accordance with applicable laws.

Organizer Liability: BookOnZaatio acts only as a booking agent for event organizers and is not a party to the event contract. We disclaim any liability for the acts or omissions of event organizers. Event organizers alone are responsible for event delivery, participant safety, event content, and compliance with laws.

3. Ticket Booking and Pricing

Ticket Purchase: When you purchase a ticket, you enter into a contract with the event organizer. BookOnZaatio only processes payment and issues a booking confirmation (a booking ID or e-ticket). Ensure you review all booking details before payment, as bookings are final. BookOnZaatio does not offer refunds or exchanges after a ticket is purchased.

Order Confirmation: After payment, you will receive a confirmation email or page with a booking ID. If you do not receive a confirmation, you must check your booking history or contact customer service. BookOnZaatio is not responsible for any loss if you assume a ticket was not booked when it was.

Limits and Restrictions: The number of tickets available per customer may be limited per event as determined by the organizer. Some events may have age or entry restrictions; please check any such requirements before booking. (For example, events may require separate tickets for children above certain ages.)

4. Payment and Ticket Delivery

Payment: You must pay the full ticket price plus any applicable fees at the time of booking. BookOnZaatio accepts various payment methods (credit/debit cards, net banking, etc.) as listed on our site. All fees and taxes (including GST) are your responsibility.

Ticket Delivery: Upon successful booking, BookOnZaatio offers multiple delivery options:

Email Confirmation: We email you a booking confirmation (e-ticket or booking ID). Print or save this confirmation to present at the venue.

SMS Confirmation: We may send a confirmation via SMS. Show the SMS at the venue.

Physical Tickets: For some events(where necessary), we will mail physical tickets by courier. We will make a reasonable effort (e.g. two delivery attempts) before cancelling a transaction.

In all cases, the booking confirmation (digital or physical) is required to gain entry to the event. You may also be asked to present the payment card used for booking when collecting tickets. BookOnZaatio is not liable for lost or stolen tickets once issued; treat your confirmation like cash.

5. Refund and Cancellation Policy

Final Sale: Except as noted below, all ticket sales are final. BookOnZaatio will not cancel or refund tickets once purchased. We explicitly disclaim any obligation to refund tickets for changed personal circumstances.

Organizer Cancellations: If an event is cancelled or postponed by the organizer, BookOnZaatio will facilitate a refund or credit per the organizer's published policy. The refund may take time as it is processed through the organizer.

Pricing Errors: If a ticket is sold at an incorrect price due to a system or typographical error, BookOnZaatio may cancel that ticket or order and refund the amount paid. We will notify you if such a cancellation occurs.

No Exchanges: BookOnZaatio does not process exchanges or modifications once a ticket is booked. Please ensure you select the correct event, date, seat (if applicable), and quantity before payment.

6. Prohibited Conduct

Personal Use Only: Tickets purchased through BookOnZaatio are for personal, non-commercial use. You agree not to resell, trade, or exploit tickets or booking confirmations for profit. Commercial resale or bulk booking of tickets is strictly prohibited.

No Unauthorized Sales: Do not purchase tickets from unauthorized third parties or accept offers from others selling BookOnZaatio booking IDs. Any person in possession of your booking ID can redeem your tickets; keep your booking details secure.

Platform Use: You agree not to use BookOnZaatio in any manner that violates laws or infringes intellectual property rights. In particular, you must not reverse-engineer, modify, copy, distribute or republish any content from the site. Violation of these rules may result in account termination.

7. Intellectual Property

All content on BookOnZaatio (text, graphics, logos, images, software, etc.) is owned by Zaatio or its licensors and is protected by copyright and other IP laws. You are granted a limited license to use the platform to book tickets. Any trademarks or logos of BookOnZaatio (or Zaatio) are our property; do not use them without permission. You may not copy, reproduce, modify, or distribute any content from the site except as reasonably necessary to view and print your ticket or booking confirmation.

8. Disclaimer of Warranties; Limitation of Liability

No Warranties: BookOnZaatio strives for accuracy but provides the platform and content "as is." We make no warranties regarding the accuracy, completeness or reliability of event information or the performance of the site. We expressly disclaim any warranties of merchantability, fitness for a particular purpose, or non-infringement.

Booking Agent Only: BookOnZaatio is only a ticketing agent for organizers. We do not guarantee that events will occur as planned, nor do we provide venue or performer services. Any issues with the event (quality, content, safety, compliance) are the organizer's responsibility.

Limitation of Liability: To the maximum extent permitted by law, in no event will BookOnZaatio (or Zaatio and its affiliates) be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or data, arising out of your use of the platform or purchase of tickets. Our total liability for any claim related to a booking is limited to the amount you paid for the ticket. This limitation applies regardless of the cause of action (contract, tort, negligence, etc.).

9. Indemnification

You agree to indemnify, defend and hold harmless BookOnZaatio, Zaatio, and their officers, directors and employees from any claims, liabilities, damages, losses or expenses (including legal fees) arising from your breach of these Terms or your use of the platform. This includes any claim arising from your purchase or use of tickets or from any content you submit.

10. Communications and Notices

We will communicate with you primarily via email, SMS or in-app notifications. You agree that any notices or confirmations delivered electronically (to the address or number you provide) satisfy any legal requirement that such communications be in writing. You must promptly update your contact information to receive important messages (booking confirmations, changes, cancellations). BookOnZaatio is not responsible for missed communications due to outdated contact details.

11. Termination of Service

BookOnZaatio may suspend or terminate your access to the platform at any time, with or without cause or notice. We may also remove any event listing or content for any reason. Upon termination, your right to use the platform ends immediately. We will not be liable to you or any third party for termination of access. You may terminate your account at any time by discontinuing use. Any outstanding obligations (e.g., payments) survive termination.

12. Governing Law; Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms (or your use of BookOnZaatio) shall be subject to the exclusive jurisdiction of the courts in Guahati, India.

13. General Provisions

Amendments: BookOnZaatio may update or revise these Terms at any time. We will post the updated Terms on our website. Your continued use of the platform after changes indicates your acceptance of the new Terms.

Entire Agreement: These Terms constitute the entire agreement between you and BookOnZaatio regarding the use of the platform and supersede any prior agreements.

No Waiver: If we delay or fail to enforce any provision of these Terms, it will not waive our right to enforce it later.
